An Australian public worker has won the workers comp. claim hearing, for the injury she got having sex in a motel during the business trip, according to ABC News. Now the federal government should pay not only the money spent on her treatment, but also cover the legal costs.
The woman, whose name was not released, sued her employer back in 2007, for the denied workers compensation claim for the injury done by a glass light fixture that fell off the wall above a bed as she was having sex. In addition, as she said later, after the injury she suffered severe stress, leading to a psychological disorder.
Australian Governmental Safety Committee refused to pay the claim and she end up paying own money for the treatment. The appellate court also backed the Committee decision. She did not give up and appealed to a higher court.
On Thursday, April 19, a federal court ruled in favor of the plaintiff and ordered the employer to pay the claim and legal expenses, because the plaintiff was injured while on a business trip.
The federal judge said if the woman had been injured playing cards in her motel room she would get compensation, and that the incident was no different.
