Why Insurance is Important
Insurance is a critical component of doing business with OUSD. It ensures that all parties are protected in case of unforeseen events, providing peace of mind and financial security. The insurance requirements vary based on the product or services of a particular vendor to the Board of Education of the Oakland Unified School District, but generally, the following requirements are included with the contract.
Key Insurance Requirements
- SAM, Sexual Abuse and Molestation Insurance: for all professionals that will be working with OUSD students, coverage for sexual abuse and molestation in the limits at least $1 million each occurrence and $2 million is required and mandatory.
- General liability Insurance shall be at least as broad as Insurance Services office General Liability Coverage (Occurrence Form CG 0001), with coverage limits of not less than One Million Dollars ($1,000,000) per occurrence for bodily injury, personal
- injury and property damage/ Two Million Dollars ($2,000,000) aggregate.
- Automobile liability insurance shall be at least as broad as Insurance Services Office Form Number CA 0001 covering Automobile Liability, Code 1 (any auto), with coverage limits of at least One Million Dollars ($1,000,000) for bodily injury and property damage each accident limit and Two Million Dollars ($2,000,000) in the aggregate.
- Professional liability – Errors and Omissions Insurance: errors and omissions insurance on an claims made basis with a limit of at least One Million Dollars ($1,000,000) per occurrence and Two Million Dollars ($2,000,000) aggregate with a deductible in an amount not to exceed the sum of Ten Thousand Dollars ($10,000.00).
- Worker’s compensation and Employer’s Liability Insurance: the business shall insure (or be a qualified self-insured) under the applicable laws relating to workers’ compensation insurance, all of their employees working on the Project, in accordance with the “Workers Compensation and Insurance Act,” Division IV of the California Labor Code and shall provide employer’s liability insurance in the amount of at least One Million Dollars ($1,000,000) per accident for bodily injury and disease.
- Builder’s risk to name the district as loss payee at 100% of contract amount for all construction contracts greater than $5 million.
- All insurance carriers must demonstrate A.M. Best financial strength rating (FSR) of A- or better.
- Name Oakland Unified School District, its board, officers, and employees as “additional insured” on the General Liability and Automobile Liability by Endorsement on separate form; provide with certificate specifying the Oakland Unified School District is noticed by the company as an “additional insured” entitled to a 30-day written, mailed notice.
